What is Exemption Fraud?

Homestead Exemption is a benefit available to Florida residents who own and occupy their home as a permanent, legal residence. This benefit reduces the taxable value of a property, resulting in lower taxes.

Exemption fraud occurs when a person improperly claims an exemption—such as claiming a Homestead Exemption while residing elsewhere, renting the home, or claiming similar benefits in another state.

Legal Penalties

Under Florida Statute 196.131(2), knowingly giving false information to claim a Homestead Exemption is a first-degree misdemeanor—punishable by up to one year in jail, a $5,000 fine, or both.

Per Florida Statute 196.161(1)(b), ineligible exemption recipients may owe up to 10 years of back taxes, plus a 50% penalty and 15% annual interest.

Note: The exemption status of a property as of January 1 determines its status for the entire year. If a property is sold after January 1, the exemption remains in effect through December 31 and will be removed the following year.
